These Terms of Service ("Terms") are an agreement between you and Madhuri Laundry and Linen Services ("CleanCart", "we", "us"). They apply when you use the CleanCart web app, a laundry website that runs on CleanCart, or the messages we send for laundries (together, the "Service").
By creating an account or using the Service, you agree to these Terms and confirm that you have read the Privacy Policy. If you do not agree, do not use the Service.
What CleanCart is
CleanCart is software that laundries use to run their business: taking orders, pricing, invoices, pickups and deliveries, and keeping customers informed. Customers use it to track their orders.
CleanCart does not provide laundry services. Each laundry on CleanCart is an independent business. When you give clothes to a laundry, your contract for that service is with the laundry, not with us. The laundry sets its prices, decides how to clean your items, and is responsible for them while they are in its care. The default laundry service terms in Laundry service terms apply between you and the laundry unless the laundry gives you its own terms.
Who can use the Service
To create an account you must:
- be at least 18 years old;
- be able to enter a legally binding contract under Indian law; and
- give true, current, and complete information, and keep it up to date.
A business or organisation may use the Service through a person authorised to act for it. That person confirms that they have that authority.
Your account
- One person, one account. Your account is for you alone. Do not share your password or let anyone else sign in as you.
- Keep it secure. You are responsible for what happens in your account. Use a strong password and sign out on shared devices. You can see and end your active sessions in the web app.
- Tell us about misuse. If you think someone else has used your account, change your password and write to support@madhurilaundry.com straight away.
- Linking to a laundry. When a laundry adds you as a customer using your mobile number or email, your orders at that laundry appear in your account. Tell the laundry if your details are wrong.
- Locked accounts. After repeated failed sign-ins we lock the account to protect it. You can unlock it by resetting your password.
Laundry owners and staff
- A laundry joins CleanCart under a separate business agreement with us. That agreement covers fees, data processing, and service levels, and takes priority over these Terms where they differ.
- Staff join a laundry by invitation. The laundry decides each staff member's role and stores, and is responsible for its staff's use of the Service.
- Laundries must collect, use, and share customer data lawfully, give customers the notices the law requires, and record marketing consent before sending promotional messages.
- A laundry is responsible for the accuracy of its prices, taxes, invoices, and records, and for keeping the business records that tax and accounting law requires.
Using the Service acceptably
You must not:
- break any law, or use the Service for fraud or to mislead anyone;
- use someone else's account, or pretend to be someone you are not;
- access data you are not authorised to see, including another laundry's data;
- try to get around security, rate limits, or access controls, or probe, scan, or test the Service for vulnerabilities without our written permission;
- interfere with or overload the Service, or introduce malware;
- copy, scrape, or collect data from the Service by automated means;
- copy, modify, reverse engineer, or resell the Service, except where the law allows it; or
- send spam, or send promotional messages to customers who have not agreed to receive them.
If you find a security problem, please report it to support@madhurilaundry.com and give us reasonable time to fix it before telling anyone else.
Orders, prices, and payments
- Prices. The laundry sets its prices and taxes. Your invoice lists every item, its price, discounts, and taxes.
- Paying. You pay the laundry directly, by cash, UPI, card at the counter, bank transfer, or another method the laundry accepts. CleanCart does not take payments from customers and does not handle your card or bank details. The laundry records your payment against your order.
- Using the Service is free for customers. Laundries pay us under their own agreement.
- Pickup cancellations. If the laundry offers pickup and you cancel an order after a pickup time has been booked, the laundry may charge ₹50 plus applicable GST. It is shown on a cancellation invoice. There is no charge if you cancel before a pickup time is booked, or if the laundry cancels. An order cannot be cancelled once processing has started.
- Billing questions. Ask the laundry first. If you cannot resolve it, you can write to us and we will help where we can, but the laundry decides refunds and credit notes.
Laundry service terms
These default terms apply between you and the laundry, unless the laundry gives you its own written terms, in which case the laundry's terms apply. CleanCart is not a party to them.
- Handover. The laundry counts and tags your items when it takes them, and notes visible stains, damage, or missing buttons. Check your receipt before you leave.
- Care labels. The laundry follows each item's care label. If an item has no label, or the label is wrong, the laundry uses its professional judgement and is not responsible for results caused by a missing or wrong label.
- Pockets and valuables. Empty all pockets. The laundry is not responsible for money, jewellery, documents, or other items left in clothes.
- Stains and wear. The laundry makes a reasonable effort to remove stains, but cannot guarantee it. Old, set-in, or unknown stains may not come out completely. Normal wear, fading, small shrinkage, and weaknesses already in the fabric may show after cleaning.
- Ready date. The ready date on your receipt is the laundry's best estimate. The laundry will tell you if it changes.
- Checking your items. Check your items when you collect them or when they are delivered. Report missing or damaged items to the laundry within 48 hours, with the receipt or order number.
- Loss or damage. If an item is lost or damaged through the laundry's fault, the laundry will compensate you up to ten times the service charge for that item, unless you agree another remedy, such as repair or re-cleaning. This does not limit any right you have under the Consumer Protection Act, 2019.
- Uncollected items. If you do not collect your items, the laundry will remind you. Items not collected 60 days after the ready date may be donated or disposed of, after the laundry has sent you a final notice.
- Pickup and delivery. If the laundry offers pickup or delivery, it agrees a time window with you. Make sure someone is available to hand over or receive the items. The laundry records the name of the person who handed over or received them.
Messages
- We send order updates and security codes as described in the Privacy Policy. These are part of the Service.
- You can ask your laundry to stop order updates. Security codes cannot be turned off, because you need them to sign in or reset your password.
- A laundry may send you promotional offers only if you have agreed to receive them. You can withdraw that agreement at any time.
Privacy
The Privacy Policy explains what personal data we collect, how we use and protect it, and your rights. It forms part of these Terms.
Intellectual property
- The Service, including its software, design, and the CleanCart name and logo, belongs to CleanCart or its licensors. We give you a personal, non-exclusive, non-transferable right to use it under these Terms. No other rights are granted.
- Each laundry's name, logo, photos, and website content belong to that laundry or its licensors.
- The data you or your laundry put into the Service remains yours or the laundry's. You give us permission to store, process, and display it only to provide the Service.
- If you send us suggestions or feedback, we may use them without any obligation to you.
Third-party services
The Service relies on other providers, such as WhatsApp for messages and OpenStreetMap for maps, and may link to websites such as Google Maps. Those services have their own terms and policies, and we are not responsible for them.
Availability and changes to the Service
We work to keep the Service available and secure, but we do not promise that it will always be available, uninterrupted, or error-free. We may need to pause it for maintenance, upgrades, or reasons outside our control. We may change, add, or remove features. If a change significantly reduces what you can do, we will give reasonable notice where we can.
Disclaimers
To the extent the law allows, the Service is provided "as is" and "as available". We do not give warranties that are not set out in these Terms, including implied warranties of fitness for a particular purpose. We are not responsible for the quality of laundry services, which is a matter between you and the laundry.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, such as loss of profits, business, or goodwill, or for losses that were not reasonably foreseeable;
- we are not liable for loss of, or damage to, items in a laundry's care; and
- our total liability to you for all claims arising out of or relating to the Service in any 12 months is limited to ₹5,000.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Indian law, including for fraud, or your rights under the Consumer Protection Act, 2019.
Indemnity
If you break these Terms or the law while using the Service, and that causes a claim against us by someone else, you agree to cover our reasonable losses and costs from that claim. This does not apply to the extent the claim was caused by us.
Suspension and closing accounts
- You can stop using the Service at any time, and ask us to close your account by writing to support@madhurilaundry.com.
- We may suspend or close an account, after notice where reasonable, if it breaks these Terms or the law, puts other users or the Service at risk, or has been inactive for a long time. In a serious case we may act immediately.
- When an account is closed, the right to use the Service ends. Records the law requires us or a laundry to keep, such as invoices, are retained as the Privacy Policy explains.
Governing law and disputes
These Terms are governed by the laws of India. If a dispute arises, please contact us first so we can try to resolve it informally. Subject to that, the courts at Nashik, Maharashtra have exclusive jurisdiction, except that you may always bring a consumer complaint before the consumer commission that the Consumer Protection Act, 2019 allows.
Changes to these Terms
We may update these Terms when the Service or the law changes. The version number and date at the top show the current version. If a change is significant, we will tell you in the web app or by message before it takes effect. If you keep using the Service after a change takes effect, the updated Terms apply. If you do not agree, stop using the Service and ask us to close your account.
General
- These Terms, the Privacy Policy, and any terms a laundry gives you for its services are the whole agreement about the Service between you and us.
- If any part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these Terms. We may transfer ours to a company that takes over the Service, if it agrees to be bound by these Terms.
- Neither party is responsible for delays caused by events outside its reasonable control.
